Overview

  • Soạn thảo, rà soát và đàm phán các loại hợp đồng liên quan đến cho thuê bất động sản (hợp đồng thuê, phụ lục, biên bản bàn giao...) và phát triển dự án (hợp đồng xây dựng, hợp đồng với nhà thầu/nhà cung cấp, hợp đồng hợp tác đầu tư, chuyển nhượng...).
  • Thực hiện rà soát pháp lý (legal due diligence) đối với các dự án, quỹ đất và tài sản mà công ty dự kiến phát triển hoặc đầu tư.
  • Tư vấn cho các bộ phận liên quan (cho thuê, phát triển dự án, vận hành) về các quy định pháp luật liên quan đến đất đai, xây dựng, kinh doanh bất động sản, đầu tư.
  • Hỗ trợ xin cấp phép, làm việc với cơ quan nhà nước có thẩm quyền liên quan đến đất đai, xây dựng và các thủ tục pháp lý khác của dự án.
  • Xác định, đánh giá và tư vấn quản trị rủi ro pháp lý cho toàn bộ danh mục bất động sản của công ty (cả tài sản cho thuê hiện có và dự án đang phát triển).
  • Cập nhật và tham mưu cho Ban lãnh đạo về các thay đổi trong quy định pháp luật có ảnh hưởng đến hoạt động kinh doanh của công ty.
  • Draft, review, and negotiate various contracts related to real estate leasing (lease agreements, appendices, handover minutes, etc.) and project development (construction contracts, contractor/supplier agreements, investment cooperation contracts, transfer agreements, etc.).
  • Conduct legal due diligence for projects, land banks, and assets that the company intends to develop or invest in.
  • Advise relevant departments (leasing, project development, operations) on legal regulations regarding land, construction, real estate business, and investment.
  • Support licensing procedures and liaise with competent state authorities regarding land, construction, and other legal procedures for projects.
  • Identify, assess, and advise on legal risk management for the company's entire real estate portfolio (including both existing leased assets and projects under development).
  • Update and advise the Board of Management on changes in legal regulations that affect the company's business operations.
